Success for headlessees and warning for surveyors following Party Wall Act judgement (Park Lane Holdings v Saidco)
Scott Goldstein, Partner and leading property litigation lawyer at Payne Hicks Beach, acted alongside Stephen Jourdan QC and Cecily Crampin for the successful appellants (headlessees) in the recently decided judgement of Park Lane Holdings Inc & Anr v Saidco & Anr.
In this convoluted case, with important implications for surveyors, the judge upheld the appeal relating to a Party Wall Award on a number of grounds: the importance of adhering to statutory procedures, the length of time to make a claim and the principle that a party wall award cannot bind anyone other than the parties to the original award.
