How to make your divorce as straightforward as possible – Family expert Rebecca Cockcroft’s article features in FT Adviser

Partner and Head of the Payne Hicks Beach Family Department, Rebecca Cockroft, shares her insights on the changing divorce laws and the important role of pre-nups and post-nups  in her article ‘No-fault divorce law change highlights pre-nup importance’ for FT Adviser, published on 29th March 2022 and linked below with kind permission.

Following the introduction of the Divorce, Dissolution and Separation Act 2020 on April 6, in her article Rebecca contrasts the “wildly unromantic and commercial” aspect of pre-nups with their practicality for smoothing the separation and divorce process.  Despite the new divorce process leaving “parties free to focus upon the key issues and bring the blame-game culture to an end” experience has taught that “if people want to create conflict and have their day in court, they will simply find other ways of doing so”. Keeping a nuptial agreement updated may also be more prudent before making “potentially life-changing decisions” even as breakups become less acrimonious.
