POTANINA V POTANIN

We act for the husband Mr Potanin in these ongoing proceedings. Mr Potanin and Mrs Potanina were divorced in Russia.

After protracted proceedings in Russian courts at all instances, Mrs Potanina was awarded a lump sum exceeding $84 million as part of the division of all the marital property. Mrs Potanina subsequently applied to the English Court for permission to bring a further claim for financial remedies here under Part III of the Matrimonial and Family Proceedings Act 1984. She was granted permission to bring her claim but that permission was subsequently set aside on the basis that she had misled the court. The wife appealed to the Court of Appeal who allowed the appeal. Mr Potanin appealed to the Supreme Court who allowed his appeal and sent the case back to the Court of Appeal to consider two grounds of appeal. The Court of Appeal has now ruled that Mrs Potanina has sufficient connection to England to be permitted to bring a claim here. The wife’s application has now been remitted to the High Court to consider the substantive application.
