What emotional support services are available for families in court? 

In recognition of Mental Health Awareness Week, it’s important to acknowledge the significant emotional toll that life events like divorce can take on individuals and families. Kelly Gerrard, explores in her article the emotional support services available for families navigating the court process.

What emotional support services are available for families in court?

It has often been said that divorce – and the associated stressors of dealing with the financial arrangements and child arrangements issues – is up there with the most stressful of life events.  Whilst many parties are able to resolve their affairs consensually through non-court dispute resolution methods such as negotiation, mediation, arbitration and more, for some there is no option but to seek the assistance of the Family Court in resolving their issues.  The Family Court is exceptionally busy and proceedings can be protracted and subject to lengthy delays.  The emotional strain on those going through proceedings can be significant.

Mental Health and Well-being

It is essential to recognise the strain that going through family proceedings places on an individual.  This is an issue that Payne Hicks Beach has focused upon in recent years and has led to the team, together with other highly regarded professionals working in this field, to develop a suite of resources (see below for a link to the full set of resources.)  We highly recommend clients going through proceedings review the “Vulnerable Clients Survival Guide” (which can be accessed here).  Prepared by the Montrose Health Group, this guide deals with the psychology of separation, signposts problematic behaviours to be aware of and offers practical advice on setting boundaries, communication and self-care tips to manage stress.

Therapists

For those who have the means, we often recommend that they engage the services of an experienced therapist who can support them emotionally whilst going through proceedings.  Private therapists usually charge an hourly rate which will typically range from £100-£200 depending on location and experience.  Organisations such as Relate can offer a cost effective counselling sessions which are priced according to household income.

Family and friends

It is possible to have a family member or friend accompany you to court to offer emotional support whilst you are waiting.  Usually they will not be permitted to accompany you into court but they can sit with you in the waiting room.  If you are unable to secure legal representation then it is possible to ask the court to permit you to have a “McKenzie Friend” to offer support (see below).

McKenzie Friend

A McKenzie Friend is not usually legally qualified but is present to provide emotional and practical support.  It may be a friend or there are individuals who offer their services for a fee.  Some charitable or support organisations (such as the Personal Support Unit) may provide McKenzie friends for free.  A McKenzie Friend can go into court with you and be shown the papers.  They can take notes during the hearing and help you organise papers or find something you wish to refer to.  You can also refer to them quietly during the hearing (for example to check with them you haven’t missed making any of the points that you wish to make.)

Support Through Court

A valuable resource for those who do not have the means to engage the services of a legal team and private therapist is available through the charity Support Through Court.  Payne Hicks Beach is a partner with this charity and supports their work.  They are manned by a team of volunteers who are able to offer support in problem solving, legal information and provide advice on court procedures and the completion of the appropriate court forms.  More information about their services can be found at their website here

Other Charities

There are a number of other organisations that offer support to those whose emotional wellbeing is affected by the process of going through the family court.  This includes organisations such as the Family Rights Group.
