New law gives power to judges to throw out cases at an early stage – Nataly Tedone comments for Law360

Nataly Tedone of our Privacy and Media Team has elaborated for Law360 readers why it could be difficult for a court to implement the measures given subjective assessments such as whether a claimant has acted in a disproportionate way when their reputation, good standing and often livelihood are under attack.

The legislation passed in late October empowers courts to dismiss so-called SLAPPs ‒ strategic lawsuit against public participation ‒ relating to the reporting of economic crime.

As with any new policy, the anti-SLAPP measure will now face the challenge of implementation, and this is difficult where the parameters are insufficiently defined.
