Scott Goldstein, property litigation partner at Payne Hicks Beach, said there was concern that the cap might “interfere with investments in freeholds built up by pension funds over many years, which are there to benefit millions”.
He said that while the government has said landlords will be protected by the courts under the new lease enforcement regime, existing court delays mean this offers “little reassurance” in practice.
