MOJ to issue divorce reform consultation ‘by spring’ – Baroness Shackleton featured in The Law Society Gazette

Baroness Shackleton, Payne Hicks Beach, had her comments featured in The Law Society Gazette’s article: MoJ to issue divorce reform consultation ‘by spring’.  Following a debate in the House of Lords as to whether divorce reform must include financial remedies, cohabitation rights and pre-nuptial agreements at once, widespread consensus once again emerged on pre-nuptial agreements.

Baroness Shackleton comments:

‘To say that this  [pre-nuptial agreements] depends on sorting out the entire matrimonial financial remedies situation, including cohabitation rights, is an absurd excuse for not dealing with an issue that is not even mentioned in the 1973 legislation as amended, and on which the Supreme Court in Granatino, now 15 years ago, invited parliament to legislate.’
