Hanna comments:
“We’re solving a problem that doesn’t really exist and can probably be dealt with through the courts as they are. We just need more regulation around how the media works.”
Hanna added that the new proposals were making litigation more costly and a lot more complicated. Hanna also notes that in the recent judgment on SLAPPS (Kamal v. Tax Policy Associates Ltd) the Judge had the ability to strike out the claim anyway but then had to go through the new SLAPPs legislation. Basha said: “All it did was basically make the arguments more complicated and arguably make the costs a lot higher.”
