Stricter UK Entry Rules: The Impact of Suspended Sentences on Immigration Decisions

The rules to visit the UK have changed, with potentially wide-ranging and severe consequences not just for individuals who seek to visit the UK, but also many of those who already have permission to do so

On 26 March 2026, the Immigration Rules were amended to mandate the refusal or cancellation of entry clearance or permission to enter where a person has received a suspended sentence of 12 months or more, regardless of whether that conviction was in the UK or overseas. This rule previously only applied to custodial sentences and will now likely lead to far more applications for Visitor visas being refused – absent proper preparation of supporting evidence.

Offences that typically carry suspended sentences are often overlooked by applicants when completing a Visitor visa application without the benefit of expert legal representation, given that they have not attracted a custodial sentence (such as certain historic driving offences as an illustrative example).

With specific regard to those seeking to visit the UK for less than six months (a very typical category of Visitor), unless more than 12 months have passed since the end of that sentence, the Immigration Rules now state that a Home Office decision-maker must refuse an application for a Visitor visa. If more than 12 months have passed, a Home Office decision maker may still refuse such an application.

The Home Office does have a residual discretion to permit entry to an applicant even in circumstances where refusal is said to be mandatory – but successful applications require compelling and targeted accompanying evidence, particularly if an applicant seeks to visit the UK by a particular date.
